This company didn't produce its annual accounts and on 2nd October 2012 the First notification of strike-off action was published in the London Gazette. Usually this would result in a strike-off if the company doesn't respond and file the accounts promptly.
If I understand it properly a creditor, for example HMRC for tax debts etc, can object to the striking off, also a company can't be struck off if legal action is already in process against the company. The company records show a notification on 10/11/12 that a compulsory strike off has been suspended.

I'm wondering if Groupon is taking legal action against the company.
If anybody wants to try and bring a legal action against a company that has already been struck off it seems that they have to apply to have it restored to the register so its probably a good thing that the company has not been struck off, although I don't suppose there's any assets to make a legal action by the ripped of customers worthwhile - I think its share capital is shown as £10
If Behind your smile had any liability insurance for personal injury then a legal action would be worthwhile if the insurers would step in and pay any judgment debt not met by Behind your Smile but it doesn't seem as though anybody has obtained any details of any liability insurance by the company or held personally by Dr Etok yet.

I would in the first instance complaint to the GDC. You need to contact their fitness to practise team and report the matter to them. They can give you advise on what options you have for corrective treatment. Richard Etok cannot be allowed to get away with this. He has got a way with it for this long because patients have been reticent to complain about him.
